BY PARTICIPATING IN OUR RAFFLE OR USING OUR WEBSITE (THE “WEBSITE”) OR OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THESE TERMS & CONDITIONS AND ALL OTHER TERMS INCORPORATED HEREIN BY REFERENCE. IT IS YOUR RESPONSIBILITY AS THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO CAREFULLY READ THE TERMS & CONDITIONS BEFORE PROCEEDING TO USE THIS WEBSITE.

THESE TERMS CONTAIN DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITIES INCLUDING ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION (SEE BELOW). ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW. THESE TERMS FORM AN ESSENTIAL BASIS OF OUR AGREEMENT.

The present Terms & Conditions (this “Agreement” “Terms & Conditions,” or “Terms”) is a legal agreement between you and the Supernus Business & Law Center (hereinafter “Supernus”), a company duly organized and validly existing, located at 735 Independence Avenue, Sycamore, Illinois 60178. This Agreement supersedes and voids all previous agreements.

OVERVIEW

The website (www.SupernusLaw.com) and the Supernus Guardian Nomination Raffle is operated by Supernus. Throughout the website, the terms “we“, “us” and “our” refer to Supernus. Supernus offers this website, including all information, tools, products, and services available from this website to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein. The Supernus Guardian Nomination is an exclusive product developed and designed by Supernus and offered to the public through the SupernusLaw.com website. Parties with Character (PWC) is an independent and unaffiliated business located in Sycamore, Illinois. Supernus has teamed up with PWC to provide this raffle exclusively for the Kirkland Fourth of July Fair, from July 1, 2022 to July 4, 2022.

By registering for our Supernus Guardian Nomination Raffle, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms & Conditions apply to all registrants, including without limitation registrants who are browsers, vendors, customers, merchants, and/or contributors of content. In the event of an inconsistency between this Agreement and any additional terms or policies referenced herein, the provisions of the additional terms or policies shall control.

Please read these Terms & Conditions carefully before registering for this raffle. By accessing or using any part of the website, you agree to be bound by these Terms & Conditions. If you do not agree to all the terms of this Agreement, then you may not access the website or use any Service. If these Terms & Conditions are considered an offer, acceptance is expressly limited to these Terms & Conditions.

PROMOTION DESCRIPTION

One lucky person will win a 2-Hour Platinum Party package from Parties with Character. Registration will start on July 1, 2022, and close at midnight on July 4th, 2022. The winner will be selected at random on July 5, 2022, and will be notified by email and through social media. *Exclusions may apply, see below.

ELIGIBILITY

In order to be eligible, you must be at least 18 years old. To enter the raffle, a person must purchase a Supernus Guardian Nomination on the website at www.SupernusLaw.com/Guardian or by using the quick-purchase QR code on the reverse side . Limit one raffle entry per person. A registration by an ineligible person is void and cannot win this prize. Registration does not need to take place at the Kirkland fair, but must be completed between July 1, 2022, and 11:59 p.m. on July 4, 2022.

OFFICIAL PRIZE

The prize for this raffle is a 2-Hour Platinum Party Package by Parties with Character, valued at $315.00. The Platinum Party Package includes a 2-hour appearance with a Parties with Character character of your choice (subject to availability and limitations defined herein), an autographed Keepsake Photo with the character and your child printed on location at your party/event, your choice of 2 themed activities (Glittering Makeovers, Keepsake Craft, Entertainment During Cake & Presents), a handwritten and personalized keepsake card, active games themed to the character of your choice, singing or hero training, interactive storytelling, and deluxe themed gift.

The raffle does not cover party expenses, party supplies, food, location costs, participants’ travel costs, or any other cost/expense associated with your event. The Platinum Party package only covers the appearance of a Parties with Character princess or superhero of your choice and the activities described above. The winner will need to make their own location, food, supplies, and travel arrangements.

WINNER SELECTION

The raffle will end on July 4, 2022, at 11:59 p.m., and the winner will be announced soon after the raffle end date. The winner will be chosen in a random drawing and will be notified by email and social media.

Verification of Winner. All potential winners are subject to verification by Supernus and Parties with Character, whose decisions are final and binding in all matters related to the Raffle. An entrant is not a winner, unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. The winner will be notified by email and on social media (Facebook). The winner will be required to sign and return a Liability and Publicity Release (“Affidavit”) (except where prohibited), which must be received by Supernus within ten (10) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner of the prize cannot be contacted, fails to respond to notification, fails to sign and return the Affidavit within the required time period (if applicable), or declines the prize, such winner forfeits the prize. In the event the prize winner is disqualified for any reason, Supernus will award the prize to an alternate winner by random drawing among all remaining eligible entries.

LIMITATIONS

The Parties with Character Platinum Party Package prize is subject to availability. Party location must be located within a 70 mile radius of Sycamore, Illinois. This prize must be used before August 1, 2023. This prize cannot be combined with other discounts, specials, or offers. This prize is transferable, subject to the limitations specified herein. This prize has no independent cash value and cannot be redeemed or exchanged for cash.

Your party or event must be held at a safe and reasonable location and at a reasonable time. Parties with Character reserves the right, at
their sole discretion, to refuse to appear at a location that they deem to be unsafe or unreasonable or at a time which they, at their sole discretion, deem to be unreasonable.

RELEASE

By receipt of any prize, winner agrees to release and hold harmless Supernus and Parties with Character and their respective subsidiary, and affiliate companies, supplies, distributors, and advertising/promotion agencies, as well as each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the raffle or receipt, use, or misuse of any prize.

PRIVACY

Except where prohibited, participation in the Raffle constitutes winner’s consent to Supernus and Parties with Character and its agents use of winner’s name, likeness, photograph, voice, opinion, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. The winner’s name will be announced publicly unless the winner requests in writing that they wish their name to be kept private.

The winner acknowledges that their name and image will be used by either Supernus or Parties with Character to announce the winner and for promotional materials, including but not limited to posting on social media, appearing in printed materials, company newsletters or mailings, and emails.

GENERAL CONDITIONS

Supernus reserves the right to cancel, suspend and/or modify the Raffle, or any part of it, if any fraud, or other factor beyond Supernus‘s reasonable control impairs the integrity or proper function of the Raffle, as determined by Supernus, in its sole discretion. In such event, Supernus reserves the right to award the prize at random from among eligible entries received up to the time of the impairment. Supernus reserves the right, in its sole discretion to disqualify any individual, without compensation, it finds to be tampering with the entry process or the operation of the Raffle or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Raffle may be a violation of criminal and civil law, and should such an attempt be made, Supernus reserves the right to seek damages from any such person to the fullest extent permitted by law. Supernus‘s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All necessary travel arrangements, location fees, cost of food and supplies, and all other expenses related to the party or event are the sole responsibility of the winner.

LIMITATION OF LIABILITY

Supernus and Parties with Character (the Released Parties) are not liable for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Raffle; (2) unauthorized human intervention in any part of the entry process of the Raffle; (3) technical or human error which may occur in the administration of the Raffle or the processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Raffle or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Raffle.

DISPUTES

Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Raffle or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a state or federal court located in DeKalb County, Illinois; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Raffle, but in no event attorney’s fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant claims all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Supernus in connection with the Raffle, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois.
